Marine Protection Rules Part 190
Current version of Part 190
This rule applies:
- in the case of the Poor Knights ATBA, every ship of more than 45 metres length overall except:
- a fishing ship engaged in a fishing operation; or
- a barge under tow provided its cargo does not include oil or any other harmful liquid substance as defined in Annex I and Annex II of MARPOL.
- in the case of the Three Kings Island ATBA, every ship of 500 tons gross tonnage or more.

Part 190 gives effect to two areas to be avoided (ATBA):
- the marine area lying between Bream Head and Cape Brett, including the Poor Knights Islands; and
- the sea area adjacent to the Three Kings Islands.
The rules instruct the owners, the charterers and masters of ships to avoid the defined areas.
‘Areas to be avoided’ is one of the mandatory ships’ routeing measures adopted by the International Maritime Organization (IMO) to protect sensitive marine environments from the risks, principally of marine oil spills, posed by shipping operations.
